The Damages (Asbestos-Related Conditions) Bill passed through its committee stage this week. The Private Members’ Bill, presented by Andrew Dismore MP, would overturn the House of Lords judgment in the Johnston case, and enable people with pleural plaques in England and Wales to claim compensation.

In an important test case the High Court in London today announced its long awaited decision on the asbestos “Trigger Case”.

The Court has ruled that sufferers of mesothelioma, a fatal tumour of the lining of the lung caused by exposure to asbestos, can continue to claim mesothelioma compensation from the insurer who provided cover at the time the deadly asbestos dust was inhaled by the sufferer.

Friday sees the High Court in London announce its decision on the latest round by the insurers to escape compensating sufferers of asbestos related diseases.

In the so called ‘Trigger Case” the insurers have argued that in cases of mesothelioma, a fatal tumour of the lining of the lung caused by exposure to asbestos, the insurers that should pay compensation are those on risk at the time the disease develops rather than those on risk when the deadly dust was inhaled by the sufferer.
